Terms of service
Month-to-month plans, you own your data, use the software lawfully, card payments go through your own processor, and our liability is limited to what you paid us in the last 12 months.
Agreement #
By creating an account or using GetGymPOS you agree to these terms on behalf of your business. If you don't agree, don't use the service.
The service #
GetGymPOS is hosted software for gyms and studios: memberships, recurring invoices, class packs, check-in, retail POS, commission, reports and an online store generated from your catalogue. Features are described on this website, including their limits. We may improve or change features; we will not remove a core feature you pay for without notice.
Accounts and users #
Keep login details secure, give each person their own login, and remove access when staff leave. You are responsible for activity under your account.
Plans, trial and payment #
Plans are billed monthly or annually in advance at the prices shown on the pricing page for your country, plus applicable taxes. The free trial needs no card. Plans renew automatically until cancelled. We may change prices with at least 30 days' notice, effective from your next renewal. See the refund and cancellation policy.
Card payments #
Payments your customers make by card are processed by the payment processor you choose, under your agreement with them. We are not a payment processor and do not hold your customers' money.
Your data #
You own the data you enter. We process it to provide the service, under our privacy policy. You can export it at any time. You are responsible for having a lawful basis to store your members' data, including any health notes.
Acceptable use #
Don't use GetGymPOS for unlawful activity, to store data you have no right to hold, to send spam, to attack the service, or to resell it without a partner agreement.
Managed website and bundle #
For the managed website and the bundle, the scope, timeline and monthly edit allowance are as described on those pages and in your order. Your domain remains registered to you. On cancellation we hand over your website content and images.
Availability and support #
We aim for high availability and schedule maintenance outside peak gym hours where possible, but don't guarantee uninterrupted service. Support is provided during the hours on the contact page.
Liability #
To the extent the law allows, the service is provided "as is", we are not liable for indirect or consequential losses, and our total liability is limited to the fees you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.
Termination #
You may cancel at any time. We may suspend accounts for non-payment or serious breach after notice where practical. After cancellation your data is kept for 30 days for export, then deleted.
Governing law #
These terms are governed by the laws applicable to the contracting entity named on your invoice, without affecting mandatory consumer or business protections in your country.
